A MLA or MLA (English: Member of the Legislative Assembly (MLA)) is an elected member of a state or sub-division of a country and represents his constituency in the Legislative Assembly.
What are the constitutional duties and responsibilities of MLA and MP? Know the answer received by the Election Commission
If you look at it this way, in a democratic system, each person has their own job, such as driver, porter, teacher, doctor, postman, ticket-checker, nurse, mamlatdar, etc. As soon as each person's name is mentioned, we immediately know his job. For example, when we hear the name of a postman, we understand that selling mail is his job, in the same way, when we hear the name of a teacher, we understand that he works to teach, but we do not know what the duties of an MLA are. All we know is that once a person becomes an MLA, he gets the right to corrupt, eat money, get good facilities and huge salaries at government expense and get a free plot and house in Gandhinagar and hold jalsa for five years.
On 2 February 2009, an RTI activist named Dev Ashish Bhattacharya filed a petition with the Election Commission of India seeking information about the responsibilities and duties of MPs and MLAs, to which the Election Commission responded by writing, "The information sought is not applicable here so no information is available". The Appellate Officer of the Election Commission, when the petitioner first appealed, directed that the petition be transferred to the Law and Justice Department and the Parliamentary Affairs Department of the Government of India.
The Lok Sabha Secretary on 3 June 2009 told petitioner Dev Ashish that "There is no such duty or responsibility fixed on the elected representatives in the Constitution of India or in the Rules of Procedure of the Lok Sabha or in any other law by which action can be taken against the inaction or failure of the elected members".
Apart from this, the Bihar Assembly, when asked for information through different state-wise RTIs, replied that "There is no law or provision by which the duties and responsibilities of legislators are determined and there is no other law by which inefficient or failed legislators can be punished. The West Bengal Legislative Assembly also denied having any laws or rules regarding MLAs. Legislatures of Haryana, Assam, Kerala etc also informed that there is no law or rule defining the duties and responsibilities of MLAs. The Sikkim Legislative Assembly informed that "it is the prime and foremost responsibility of the elected MLAs to maintain public peace, social harmony among the people of caste and religion in their constituencies". There is currently no rule or law defining the duties and responsibilities of an elected public representative in Gujarat.
Thus, the government and the leaders who run the government determine the duty and responsibility of every government employee and every citizen but there is no law as to how much responsibility they have as representatives of the people. The time has come for the youth of the new generation to demand that a government employee should be suspended if he does not perform his duty, a citizen should be fined if he does not follow the rules, the same way an elected representative should be punished if he does not do the work of the people and his post five years earlier. There seems to be a need for a law that can be removed from above.
